If you live in the USA you have rights.
All people living within the United States, including undocumented immigrants, have certain rights under the U.S. Constitution.
If you are undocumented and immigration officers (ICE) knock on the door, know that you have the following rights:
(I.e. Don't open the door. You do not have to let immigration officers in without a valid court order signed by a judge. An ICE deportation order is not enough.
If they claim to have a warrant, ask them to pass it under the door or show it through the window. If the order has errors or is not signed, do not open the door. You can talk to them without opening it, or leave and close the door behind you.
You have the right to remain silent.
You do not need to speak to immigration officers or answer their questions. If you are asked where she was born or how she entered the US, you can refuse to answer or remain silent. Say it out loud if you decide to remain silent.
You may show a rights card indicating your desire to consult with an attorney. Do not present identification documents that indicate your country of origin and never use false documents or lie.
You have the right to speak to a lawyer.
If you are detained, you have the right to contact a lawyer immediately. Even if you don't have a lawyer, tell the officers you want to speak with one. If you have an attorney, consult with him/her and submit Form G-28 if you have one. If you prefer, you can call us at 888-666-8820.
If you do not have a lawyer, and cannot currently afford one, ask for a list of pro bono lawyers. You can also call your consulate for help.
Do not sign anything without consulting a lawyer. If you decide to sign, make sure you fully understand the document.
How to locate a person detained by ICE.
Finding a detention center: To search for a person detained by ICE, use the detainee locator (select Spanish in the “Select a different language” menu).
If you cannot find the person online, contact the Your state's Detention and Removal Office.
If you know where the person is being held, contact the corresponding detention center.
Status of an immigration case.
To find out the status of an immigration case in court use the automatic online case reporting system (in English) or call 1-800-898-7180 (press 2 for Spanish).
Immigration status refers to the how a person is present in the United States. Everyone has an immigration status. Some examples of immigration status are: US citizen.
Some cases may take longer than 180 days due to factors beyond the AAO's control.. For example, additional documentation may be needed to complete the record, or the case may be more complex and require additional review.
