¿Qué es la Visa IR-5?

The IR-5 visa is an immigrant visa that allows U.S. citizens to sponsor their foreign-born parents for permanent residence in the United States. To be eligible, the U.S. citizen must be at least 21 years old. The IR-5 visa is processed through the U.S. embassy or consulate in the parents' home country. This visa facilitates family reunification, allowing the parents to legally live in the United States as permanent residents.

Application Process

  • Filing the Petition : The U.S. citizen must file Form I-130, Petition for Alien Relative, with the U.S. Citizenship and Immigration Services (USCIS). This form establishes the relationship between the citizen and the foreign parent.
  • Petition Approval : Once USCIS approves Form I-130, the case is sent to the National Visa Center (NVC) for further processing. The NVC handles document collection and fee payments.
  • Visa Application : The foreign parent must complete Form DS-260, Immigrant Visa Application, and provide supporting documentation, such as the sponsoring child's birth certificate, the child's naturalization or citizenship certificate, and other documents that prove the relationship.
  • Consular Interview : The foreign parent must attend an interview at the U.S. embassy or consulate in their home country. During this interview, a consular officer will review the application and submitted documentation to determine eligibility.
  • Visa Issuance : If the application is approved, an IR-5 visa will be issued, allowing the father to enter the United States as a permanent resident.

Benefits of the IR-5 Visa

  • Family Reunification : Allows U.S. citizens to bring their parents to live with them in the United States, promoting family unity.
  • Permanent Residence : Parents who obtain an IR-5 visa become legal permanent residents, allowing them to live and work in the United States indefinitely.
  • Access to Services : As permanent residents, parents will have access to certain benefits and services available to permanent residents, such as healthcare and education.
